On Tuesday, Senior Reporter for Real Clear Investigations Paul Sperry reported that legal insiders have told him that one of Jack Smith's charges against Trump could be thrown out.
"Legal insiders say Jack Smith's USC 1001 false statement charges against Trump will be tossed since Trump was never even interviewed by a federal agent," Sperry reported. As of this report, Sperry's claims have not been corroborated though if true they could spell trouble for Smith's case.

"Jack Smith's Jan. 6 indictment of Trump repeatedly relies on a fuselage of subjective, even inflammatory language devoid of underlying facts and evidence to appeal emotionally to jurors," Sperry explained, adding that it includes 63 instances of the words "fraudulent/fraudulently," 94 instances of "false/falsely," five instances of the word "fake," and three instances of "sham."

Sperry also reported on the classified document case against Trump. The reporter explained, "Jack Smith's Mar-a-Lago obstruction case against Trump is based on an emailed 'emoji' related to security camera footage that was never actual destroyed, according to legal insiders."

As previously reported by the DC Enquirer, Jack Smith has brought two indictments against President Trump in recent months with the first being related to Trump's holding of supposedly classified documents at his Mar-a-Lago estate and the other focused around his action following the 2020 election.
The special counsel's office has recently been exposed to have been in contact with the White House just weeks before Smith brought forth his indictment against President Trump, as previously reported by the DC Enquirer. On March 31, 2023, at 10:00 a.m., Caroline Saba, deputy chief of staff for the White House counsel’s office, and Jay Bratt, a top aide to special counsel Jack Smith, held a meeting at 1600 Pennsylvania Avenue just weeks before Trump's charges were brought.
While it is unknown what exactly the two discussed, it does raise questions as to whether or not the White House is attempting to influence the case against Biden's leading political opponent. Peter Carr, a spokesman for the special counsel, claimed that the meeting was simply for a “case-related interview."
As Trump stares down four indictments and various other civil cases in the next year, the news of potential charges being dropped comes as a good sign for the former president. He can use any help he can get as Democrat prosecutors and the Biden DOJ attempt to stop him from running for a second term and allowing the American people to decide who they want to serve as president of the United States.
