On Monday, Texas Attorney General Ken Paxton (R-TX) filed a lawsuit alongside America First Legal against the Biden administration for the recent changes made to Title IX that inserted radical gender ideology into the rules governing K-12 education as well as colleges and universities.
As previously reported by the DC Enquirer, the Biden administration updated Title IX earlier this month by including sexual orientation and gender identity as protected classes. The change could open up colleges and universities that receive federal funding to lawsuits if they refuse to allow male students who identify as females to access women's locker rooms. The new rules also could put female athletes' scholarships at risk, and it also reverses the hard-fought due process protections for those accused of sexual harassment.
The Biden administration initially attempted to propose a rule that would have forced federally funded institutions to allow men who identify as female to compete in women's sports, but they reversed course after considerable backlash and the upcoming 2024 election. The Title IX changes were made amid considerable scrutiny, with hundreds of thousands of comments from the public being considered.
In response to the changes, which former Trump Education Secretary Betsy DeVos said were "an assault on women and girls," Ken Paxton asserted that the change was blatantly illegal. "Texas will not allow Joe Biden to rewrite Title IX at whim, destroying legal protections for women in furtherance of his radical obsession with gender ideology," Attorney General Paxton said. "This attempt to subvert federal law is plainly illegal, undemocratic, and divorced from reality. Texas will always take the lead to oppose Biden's extremist, destructive policies that put women at risk."
America First Legal President Stephen Miller also slammed the Biden administration's illegal move, explaining, "America First Legal is honored to stand with the great Ken Paxton and the State of Texas in filing this emergency lawsuit to stop Biden's war on women. Biden's new Title IX regulation is a vile obscenity: it forces women and girls to share locker rooms and restrooms with men. It forces them to call a he, a she, and to pretend in every way that a man is a woman, humiliating, degrading, and erasing women. This is an abomination, and as outside counsel for Texas we will battle this regulation in court with all the legal fight we can bring. It must be defeated for the sake of American women and for the sake of our daughters."
